Watermark Safari Tanzania: Terms and Conditions
These Terms and Conditions outline the agreement between you, the Client, and Watermark Safari Tanzania (the "Company") for all booked tours and services.
1. Agreement and Acceptance

Binding Agreement: By confirming your booking and submitting the required deposit payment, you confirm that you have read, understood, and agreed to these Terms and Conditions in full.

Company Role: Watermark Safari Tanzania acts solely as an agent to arrange transportation, accommodation, and other services provided by independent third-party suppliers (lodges, airlines, park services, etc.). The Company is not liable for the acts or omissions of these suppliers.
2. Booking, Payments, and Pricing
Booking & Payment

Deposit: A non-refundable deposit of 30% of the total tour price is required to secure and confirm your booking.

Final Payment: The remaining balance must be paid in full no later than 45 days prior to your scheduled safari departure date.

Last-Minute Bookings: If booking within 45 days of departure, the full payment is due immediately upon confirmation.

Payment Responsibility: All bank transfer fees, transaction fees, or credit card surcharges are the sole responsibility of the Client.
Pricing

Prices are quoted in USD and are guaranteed only once the full payment is received.

What's Not Included: Prices do not cover international flights, Tanzanian visas, medical/travel insurance, tips/gratuities, laundry, or personal items.

Surcharges: The Company may apply a surcharge if costs increase due to external factors (e.g., sudden park fee hikes, fuel surcharges). If this increase exceeds 10% of the total price, you have the option to cancel for a full refund or accept the new price.
3. Changes and Cancellations
Amendments by Client

Any request to change a confirmed date, itinerary, or participant numbers must be submitted in writing.

Changes are subject to availability and may incur an administrative amendment fee of $50 USD per change, plus any actual cancellation costs levied by suppliers (hotels, airlines, etc.).
Cancellation by Client
Cancellations must be communicated to us in writing. The cancellation fee charged on the total tour price is as follows:

More than 60 days before departure: The Deposit is retained by the Company.

31 to 60 days before departure: A fee of 50% of the total tour cost will be charged.

30 days or less before departure, or a "No Show": A fee of 100% of the total tour cost will be charged.

Refund Processing: If a cancellation fee is charged, any portion of the money paid beyond that fee that is refundable by our suppliers will be returned to you, though this may take time as we wait for supplier refunds.
Cancellation by Watermark Safari Tanzania

If we must cancel your tour due to unavoidable circumstances (such as severe weather, civil unrest, or government mandate—known as Force Majeure), we will offer you a full refund of all monies paid, or the option to reschedule. This refund is the full extent of our liability to you in such an event.
4. Essential Client Obligations
Documentation & Health

Travel Documents: It is your sole responsibility to obtain valid passports (at least six months validity), the correct Tanzanian visa, and all required health documentation before travel. We are not liable if you are denied entry due to documentation errors.

Mandatory Insurance: You must have comprehensive travel insurance covering medical emergencies, emergency evacuation, and trip cancellation/curtailment.

Medical Conditions: You must fully disclose any pre-existing medical conditions or special needs in writing at the time of booking so we can advise on suitability.
Safety & Conduct

Assumption of Risk: You accept that all safaris and adventure travel involve inherent personal risks, and you participate at your own risk.

Guide Authority: You must at all times comply with the instructions and decisions of your appointed Watermark Safari Tanzania guide or representative, as these are final regarding safety and logistics.

Local Laws: You must respect all Tanzanian laws and local customs. Failure to comply may result in your tour being ended immediately at your own expense.
Baggage

All luggage is carried at the Client's own risk. We are not liable for loss or damage to personal belongings. Be prepared to meet strict baggage weight and size limits (typically 15kg in soft-sided bags) for internal transport.
5. Governing Law

This contract is governed by the laws of The United Republic of Tanzania. Any legal disputes will be settled in the appropriate courts in Arusha, Tanzania.
